"Last Week I had two phone calls on the same day with potential clients who have had the same problem with their Mortgage Accounts, that my Clients the Filsons, had in 2001." Ellis explained the callers complaints allege that WELLS FARGO and AMERICA'S SERVICING are not properly crediting consumer's accounts, are holding Customer's money in "SUSPENSE ACCOUNTS" without autohrity, and will not allow the customers to use their own money held by the bank, to bring the account status Up-to-date.
"This is exactly what the did to my clients in 2001," ELLIS explained. "We are beginning preparations for Class Action Litigation. We are actively inviting calls from Wells Fargo Customers who have been foreclosed on, or who have had problems getting credit for their payments." WELLS FARGO MADE A CONFIEDNTIAL SETTLEMENT WITH JOHN AND ANGELA FILSON ON JUNE 6, 2009. Press Release History follows:
NEWS RELEASE ----- August 25, 2008. The Tennessee Court of Appeals Issued its Opinion today that WELLS FARGO BREACHED THE CONTRACT between itself and the Homeowner / Borrowers, John & Angela Filson. Wells must pay Damages. Upholding the Jury's Verdict on liability, the Court has remanded the case back to the trial level in order for the Filsons to have an opportunity to prove more Damages.
HISTORY:
The case begain 6 years ago when Wells Fargo Home Mortgage, Inc., drafted $970 from the Filson's Bank through an automatic mortgage payment program. Without informing the Homeowners, Wells Fargo then applied only $62 to the mortgage and put the $908 balance in a secret "Suspense Account."
Then, again without informing the homeowners, they stopped drafting the mortgage payments and deliberately put the Filson's house (of 10 years and $75,000 equity) into foreclosure. After 4 months the secret Suspense Account was discovered but Wells Fargo told Mr. Filson he could not have his money back (the $908), or use it to stop their expected foreclosure! Mr. Filson even offered to pay the total reinstatement balance including all fees caused by their mismanagement (almost $10,000) if he could use his own money (the $908) to pay the total amount due .... they still said No.
ATTORNEY INTERVIEW:
"I honestly doubted Mr. Filson when he first came to my Office. I mean this story is outrageous!" said the Filson's Attorney, Johnny Ellis. "But everything checked out.
"Now, before I went to law school, I worked 5 years for a mortgage company. I understand the mortgage industry, and knew almost exactly what had happened" Ellis explained, "I really thought that this would all stop once someone with authority learned about the problem, I mean, they screwed up! how could thay ever expect to win?
"If they had treated this like a mistake and fixed the problem, we would not have gotten a Quarter Million Dollar Verdict. They have made this case drag on. I had to deal with 7 different lawyers, and interview witnesses in 4 states. I'm sure WELLS FARGO has spent twice the amount of the Mortgage Balance, ($102,000) in Attorney's Fees just in trying to take away the Filson's home," said Ellis.
"I tell everybody Not to EVER sign up with Wells Fargo's, or America's Servicing Company's, Auto Mortgage Payment (AMP) program. Once they take your money, apparently it's up to them what they do with it. In our case we have had to fight like hell to get it back, or even get credit for it."
Ellis Concluded the interview saying, "I feel great going forward. Wells Fargo out spent me 100:1, they hired two of the biggest and best law firms in the Country, and they dragged this out over 6 years. But when you're Right you're Right. Mr. and Mrs. Filson faced down one of the Biggest Banks in the world. We took the best they could dish out and the Jury, and now the Court of Appeals, is forcing them to respect the rights of Tennesseans."

NEWS RELEASE ----- Court of Appeals to hear Argument from WELLS FARGO May 15, 2008. Bank to explain why they should not have to pay for terrorizing family with wrongful foreclosure after AUTOMATIC PAYMENT was never credited. -------
"I'm looking forward to hearing them explain to the Judges why they froze my client's account and would not let them use that money to pay their mortgage," said plaintiff's attorney, Johnny Ellis.
"I don't think that their attorneys are thinking this all the way through" Ellis continued, "If this becomes a reported case, it will become the formal law of the land, and open the flood gates for litigation. It is just a fact that in any contract, BOTH parties have obligations.

NEWS RELEASE ----- Nov. 14, 2006: JURY AWARDS $250,000 Verdict against WELLS FARGO HOME MORTGAGE, Inc. 5 year ordeal ends against mortgage servicer that manages millions of accounts each month!
Attorneys JOHNNY ELLIS & ROBERT LEWIS, Jr. Obtained the Jury Verdict during a two day trial in Nashville, Tennessee.
"The Jury found Breach of Contract and awarded my clients $250,000." said Ellis after the trial. "The 'Suspense Account' was a key issue."
"It's hard to get a large award from a Davidson County jury but I think the size of this verdict shows that they gave us everything they could under the law.
"Wells Fargo has never admitted their mistake, but the jury decided that they had breached the contract and gave my Clients a nice award.

"They have hired one of the largest, most influential Law firms in the NATION to try and beat my two young clients who only wanted to buy a house. Clearly, they are going to spare no expense in the effort to reverse this case"
"I am flattered that they have hired a firm with over 200 lawyers to try and change what our two lawyers, and the jury did," ELLIS continued, "it is extremely rare that a bank is found to be in breach of their own contract, but I am certain that the jury had sufficient evidence to find breach of contract, and that's just what they did."
