WELLS FARGO HOME MORTGAGE, INC. In January 2001, our Clients, John and Angela Filson, signed up with Wells Fargo Home Mortgage, Inc.'s Automatic Mortgage Payment Program, or "AMP". After months of failing to begin the Automatic Payment, Wells Fargo made the first Automatic Draft from the Filson's Account. (See Bank Statement) That money was never posted as a Mortgage Payment. Wells Fargo did not advise the Filson's that they had not credited the Payment, then quit making any further withdrawals putting the account into a delinquent status. In January of 2002. Wells Fargo began Foreclosure. After 5 months of arguing and numerous phone calls, Wells Fargo disclosed to Mr. Filson that they had held $908.18 in a secret "suspense" account. The Suspense Account held money that was acollected by Wells Fargo but not applied in acordance with the terms of the Mortgage Agreement. These funds were received by Wells Fargo but not applied to any the account. It was like a savings account. On 1/14/2002, Mr. Filson agreed to pay the total amount of money due to stop the foreclosure. However, he asked that the $908.18 be withdrawan from his "suspense" savings account, and credited to his account as part of the money he was to pay to stop the foreclosure. Astonishingly, he was told that he could not use his own money, held in that suspense savings account, to help stop the pending foreclosure on his home. (See Customer Call Notes, page 2-021) Johnny Ellis filed Suit against Wells Fargo Home Mortgage, Inc, (Now a wholly owned subsidiary of Wells Fargo Bank, NA) and stopped the Foreclosure 24 hours before the sale.

Johnny Ellis Saved his clients' inheritance rights. Cousins try to take property valued at over $350,000.
"In 1957 my clients were orphaned," stated Ellis, "They were all just young children then. But they inherited this Williamson County Farm, (photo at left) and their Uncle started living on it. Everybody knew that it was a family farm, but after the Uncle died, his son tried to take the whole thing by prescription, or 'squatters rights.'
The Court of Appeals said that you cannot use that law, prescription, against a minor child. You have to wait until they are 18, and are legally able to challenge your right to possession, before you can get squat."

The Bank foreclosed, and their 3 bedroom home was sold for less than $30,000. The new Owner did not wait for them to move out, and emptied everything out of the house without proper eviction notice, while they were away from home and at work.
